We are involved in leadership positions in the Estate and Trust bar in Ontario and in Nova Scotia, and we frequently speak at conferences and continuing professional development seminars on the topic of Estate Litigation.

Closely related to Estate Litigation is the field of Trust Litigation. This complex area of law often involves questions regarding the performance of fiduciary duties and the responsibility owed by fiduciaries to beneficiaries.

We regularly act as litigation counsel on complex trust disputes in Ontario, Nova Scotia and British Columbia for fiduciaries or beneficiaries. We are involved in leadership positions in the Estate and Trust bar, and we frequently speak at conferences and continuing professional development seminars on the topic of Trust Litigation.

We regularly act in contentious Power of Attorney Litigation matters for individuals incapable of managing their affairs and for their family members, friends or appointed Attorneys for Property or Personal Care. We are often involved in all stages of guardianship proceedings and matters under the Substitute Decisions Act.

Passings of Accounts are complex proceedings by which a Court conducts an audit of a fiduciary’s accounts. We have experience as litigation counsel during all stages of contested and uncontested Passings of Accounts, whether acting for beneficiaries or fiduciaries.

Our lawyers have acted as lead counsel in all levels of Court in Ontario, Nova Scotia and British Columbia, and in particular, we have acted as counsel in precedent setting cases regarding probate and undue influence.

We have also acted as counsel in Judicial Reviews of administrative board decisions.

We frequently act as counsel in civil litigation matters, including professional negligence, elder abuse and commercial disputes. We also have experience in circumstances of nursing home negligence.
